Filing a VA Notice of Disagreement

Justice is served

As a veteran who has sustained injuries or developed an illness as a result of a service-related activity, you are eligible to file for VA benefits for your disability. Unfortunately, the VA does not always approve your claim or give your disability the rating it needs for appropriate compensation. If your claim is denied, you have the option to appeal.

Appealing Your VA Benefits Decision

Once you have received your letter from the Veterans Administration stating that your claim has been denied—be sure it’s not a pre-determination notice—you have up to 1 year to file a Notice of Disagreement (NOD) with the VA.

The Notice of Disagreement is a statement notifying the VA that you disagree with their decision regarding your claim. An experienced veteran’s disability benefits attorney such as those at The Standridge Law Firm, P.C. can help you carefully craft this statement so that it explicitly explains which reasons of denial you disagree with. After filing the VA Notice of Disagreement, your case may be transferred to an appellate review for which you and your attorney can diligently prepare.

Prepping for Appellate Review

To expedite your case, it is important to have your case reviewed at the regional office level rather than by the traveling Board of Veterans’ Appeals (BVA). In preparation for your appeal, it is crucial that you and your attorney gather as much medical and factual evidence as possible to present to the VA.

The evidence of your legal appeals claim should be outlined in a Statement of the Case and reviewed by the appeals board. Based on this evidence as well as possible hearings, a second decision may be made regarding your VA benefits. If this decision needs to be appealed, our veteran’s rights attorneys are ready and willing to present your case to the BVA or United States Court of Appeals for Veterans’ Claims.
